Asset Protection Bridge Trusts

The Ultimate Lawsuit Deterrent for California Professionals

California is one of the most lawsuit‑heavy states in the country. If you own property, run a business, or work in a high‑risk profession, your assets are exposed — often far more than you realize. A Bridge Trust® is the strongest, court‑tested asset protection structure available to Californians who want to stay in control of their wealth while shielding it from creditors, judgements, and predatory litigation.

What Is a Bridge Trust®?

A Bridge Trust® is a hybrid asset protection trust that begins as a domestic U.S. trust and can convert into a fully foreign (offshore) trust — typically in the Cook Islands jurisdiction — only if a lawsuit or “Event of Duress” occurs.

This gives you the best of both worlds:

  • Domestic control and simplicity during normal life
  • Foreign-level protection when a legal threat appears

Until triggered, you remain in full control of your assets. If a lawsuit arises, the trust’s secondary rules activate, placing your assets behind the strongest legal barrier available worldwide.

How the Bridge Trust® Protects You

When a lawsuit threatens your assets, the trust automatically shifts into offshore mode.

At that moment:

  • Courts and creditors are legally blocked from accessing trust assets
  • You remain the beneficiary and can still receive indirect benefits
  • A foreign trustee steps in to administer the trust under Cook Islands law
  • Your assets stay protected without needing to physically leave the U.S.

Examples of protected access: The offshore trustee may lease a car, rent a home, or pay beneficiary expenses — keeping your lifestyle intact while your assets remain untouchable.

Who Needs a Bridge Trust®?

The Bridge Trust® is ideal for clients with $250,000+ in exposed assets, especially in California’s aggressive litigation environment.

Common high‑risk groups include:

  • Landlords (multi‑unit or high‑value rentals)
  • Physicians, Dentists, and Chiropractors
  • Business owners
  • Anyone perceived as having “deep pockets”

If you have assets you want to keep — you need to understand the Bridge Trust® BEFORE there is a verdict in court.

The AMLP + Bridge Trust® Structure

A Fortified Multi‑Layer Protection System

As part of your plan, we establish an Arizona Asset Management Limited Partnership (AMLP):

  • You serve as the 1% General Partner
  • Your spouse/children hold 1% Limited Partner interests
  • The Bridge Trust® holds 98% as the majority Limited Partner

Arizona is chosen because its statutes make creditor attacks extremely difficult, and the partnership does not require annual renewal.

The AMLP owns:

  • Safe assets (stocks, bonds, notes, collectibles)
  • Equity in LLCs holding higher‑risk assets

If a lawsuit arises, the Bridge Trust® can legally move AMLP assets under foreign jurisdiction — without losing beneficial ownership or tax advantages.

Foreign Protection When Triggered

Offshore Strength Without Offshore Complexity

If an Event of Duress occurs:

  • The Bridge Trust® becomes governed by Cook Islands law with a short statutory limit
  • A Foreign Successor Trustee administers the trust
  • Assets may be moved offshore if necessary
  • You retain beneficial rights and can request distributions
  • A Trust Protector (typically Lodmell & Lodmell) oversees all trustee actions

Once the threat ends, the trust can be re-domesticated.

Tax Neutral & Legally Compliant

A Bridge Trust® is tax neutral — no special tax benefits or penalties. It is designed to protect assets, not evade taxes.

It can own:

  • S‑Corp stock
  • Annuities
  • Personal residences (while preserving tax-free capital gains and deductions)

Note: It cannot hold IRAs or qualified retirement plans, but it can be named as a beneficiary.
